NOTICE OF
ADOPTION
    NOTICE IS HEREBY GIVEN that the Board of Trustees of Village of East Hampton, Suffolk County, New York, at a meeting held on May 5, 2011, duly adopted the resolution summarized below, subject to a permissive referendum.
    The resolution provides that the faith and credit of the Village of East Hampton, Suffolk County, New York, are irrevocably pledged for the payment of the principal of and interest on such obligations as the same respectively become due and payable; that an annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year; that the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the bonds authorized by such resolution, including renewals of such notes, is delegated to the Village Treasurer; that all other matters, except as provided in such resolution, relating to the bonds authorized, including the date, denominations, maturities and interest payment dates, within the limitations prescribed in such resolution and the manner of the execution of the same and also including the consolidation with other issues, and the authority to issue such obligations on the basis of substantially level or declining annual debt service, is delegated to and shall be determined by the Village Treasurer; and that this LEGAL NOTICE shall be published.
    The summary of the bond resolution follows: 
    BOND RESOLUTION DATED MAY 5, 2011.
    A RESOLUTION AUTHORIZING THE ISSUANCE OF $550,000 BONDS OF THE VILLAGE OF EAST HAMPTON, SUFFOLK COUNTY, NEW YORK, TO PAY THE COST OF THE FITHIAN LANE DRAINAGE IMPROVEMENTS, IN AND FOR SAID VILLAGE.
    The period of probable usefulness of the aforesaid class of objects or purposes is thirty years, pursuant to subdivision three of paragraph a of Section 11.00 of the Local Finance Law.

    BE IT ENACTED by the Board of Trustees of the Village of East Hampton as follows:
    SECTION I. Legislative Purpose and Intent. To offer available parking to individuals not possessing
beach parking permits for a daily fee, which is to paid to the parking lot attendant in return for a receipt stub to be displayed on the dashboard, limited to Monday thru Friday, excluding holidays at Two Mile Hollow Beach. At Main Beach, daily parking will be available Monday thru Friday. In addition, at Main Beach only, daily parking will be available Saturdays, Sundays and holidays for not more than twenty-five vehicles.
    SECTION II. Chapter 267 of the Code of the Village of East Hampton is hereby amended as
follows; struck-thru material is to be deleted; underlined material is to be added):
    ß 267-5. Vehicle and Traffic; Beach parking.
    D. Limited Daily Parking Available by Fee for Non-Permit Holders.
    Daily parking is available on a limited basis for individuals not possessing a beach
parking permit at a daily fee, which shall, from time to time, be fixed by resolution of the Board of Trustees. Daily parking is available Monday thru Friday only, excluding holidays, at the listed locations following beaches and days stated:
    (1) Main Beach - village-owned parking lot adjoining the easterly side of Ocean Avenue: on Monday thru Friday. In addition, daily parking will be available Saturdays, Sundays and holidays for not more than twenty-five vehicles.
    (2) Two Mile Hollow Beach Parking Lot: Monday thru Friday, excluding holidays.
    SECTION II. SEVERABILITY.
    If any section or subsection, paragraph, clause, phrase or provision of this law shall be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional.
    SECTION III. EFFECTIVE DATE
    This local law shall take effect upon filing with the Secretary of State pursuant to the Municipal Home Rule Law.

NOTICE
    NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Incorporated Village of East Hampton will hold a public meeting at the Emergency Services Building, One Cedar Street, East Hampton, New York, on Friday, May 27, 2011, at 11:00 a.m. on the following applications and to conduct such other business as may come before the Board:
    Application of Dennis S. and Janet Page, SCTM #301-1-1-6, for an Area Variance to allow construction of a 245 square foot patio resulting in a total coverage of 2,189 square feet where the maximum permitted coverage of Section 278-3.A.(6) is 1,958 square feet. The subject property is 7,293 square feet in area and is located at 186 Newtown Lane in Residence District R-40. This project is classified as a Type II Action in accordance with SEQR.
    Application of Nick Capstick-Dale, SCTM #301-4-10-3, for a Special Permit and Freshwater Wetlands Permit as the property contains a legal preexisting nonconforming one-story frame building consisting of a one-car garage with a bedroom, bath, and sitting room and proposes demolition and construction within the required wetland setbacks of 125 feet for landscaping, 150 feet for structures, and 200 feet for discharge systems. Section 278-7.D.(1)(a) stipulates that the extension or alteration of an existing nonconforming use and the buildings or structures related to such use including the erection of new nonconforming buildings and structures is subject to the issuance of a Special Permit. A Freshwater Wetlands Permit is required to allow removal of the existing residence, accessory structures, and other improvements in order to construct a new residence, swimming pool, deck, permeable gravel driveway, upgraded sanitary system, and drainage structures. Landscaping will occur as close as 28 feet from wetlands with the stabilization of areas disturbed by the removal of the existing shed and landscaping walls and stabilization of areas disturbed by the proposed construction. The project proposes silt fencing with hay bales approximately 50 feet landward of the wetlands edge traversing the rear of the property. Wetlands setbacks for the proposed structures are as follows: residence 73 feet, pool 77 feet, decks 71.3 feet, and permeable driveway approximately 50 feet. The wetland setback for the proposed upgraded sanitary system for the residence and lawfully preexisting nonconforming one-story structure is 140.8 feet while drainage structures to accommodate 2 inch rainfall and pool drainage are proposed as close as 67.5 feet from wetlands. The subject property is 27,830 square feet in area and is located at 95 Egypt Lane in Residence District R-40. The property adjoins the Huntting Lane Historic District and is identified in the East Hampton Village Open Space Program, an element of the Comprehensive Plan, wherein a wetlands easement is recommended. A Freshwater Wetlands Permit has been obtained from the New York State Department of Environmental Conservation. This project is classified as a Type II Action in accordance with SEQR.
