A Local Law amending Chapter 278 (Zoning Code) to clarify that a special permit is required for the construction or installation of any new structures on a lot used for a nonconforming use.
BE IT ENACTED by the Board of Trustees of the Village of East Hampton as follows:
SECTION I. Legislative Purpose and Intent. The Comprehensive Plan for the Village of East Hampton favors the elimination of pre-existing nonconforming uses. The Board of Trustees recognizes that an application to make any alterations to a lot upon which a nonconforming use is conducted, including the construction of new buildings or installation of new structures which conform to the Zoning Code in all other respects, presents an opportunity to evaluate whether the nonconforming use may be expanded as a result and whether there is an opportunity for the applicant to reduce or eliminate the nonconforming use in the course of making alterations to the lot. The intent of this local law is to clarify the Code provisions to better reflect existing policy and practice.
SECTION II. Chapter 278-3 of the Code of the Village of East Hampton is hereby amended as follows (underlined material is to be added; bracketed material is to be deleted):
ß278-7. Board of Appeals; variances; special permits; fees.

D. Special permits.
(1) The Board of Appeals, as lead agency pursuant to the State Environmental Quality Review Act, upon application after due notice and public hearing, may issue special permits for the following uses which are allowed by special permit only. Any such application for a special permit, with the exclusion of applications involving properties with one-family residential uses only and the buildings or structures related to such uses, shall not be deemed complete, and therefore ready for a public hearing, until the Design Review Board has concluded its preliminary review pursuant to 121 of the East Hampton Village Code.
The extension or alteration of an existing nonconforming use and the buildings or structures related to such use [including] and the erection of new [nonconforming] buildings and structures on any lot used for a nonconforming use, except for the installation of solar panels on an existing roof and the related equipment. However, outdoor dining shall be prohibited in all residential districts on lots used for a preexisting nonconforming use.
SECTION III. SEVERABILITY.
If any section or subsection, paragraph, clause, phrase or provision of this law shall be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional.
SECTION IV. EFFECTIVE DATE
This local law shall take effect upon filing with the Secretary of State pursuant to the Municipal Home Rule Law.

Notice is hereby given that the Springs Union Free School District will receive bids for Roof Replacement in a sealed envelope at the School District Office, located at 48 School Street, East Hampton, New York. Bids will be received until 2:00 p.m. on August 5, 2011.
The project is to remove and replace membrane roofing over the gymnasium and remove and replace asphalt shingles on some of the older sections of the school. Project manual including specifications has been prepared by Chaleff & Rogers, Architects, P.C. The documents can be reviewed at the Business Office of the Springs School starting July 21, 2011. Copies of documents may be obtained from the school, by paying a deposit of $25 per set. Any contractor who has paid the deposit and who submits a bid, and who returns the set in good condition, within 30 days after the bid opening, will receive repayment of the full amount of the deposit. Checks for deposits are to be made out to Springs School.
Bids are to comply with the requirements stated in the Instructions to Bidders. WHEREAS, the exterior windows of said meeting room have never been replaced, and
WHEREAS, the Board of Fire Commissioners has determined that the wooden frames and operating mechanisms of said windows have reached the end of their useful life, and
WHEREAS, the Board of Fire Commissioners has carefully considered the most effective method of replacing the meeting room windows, while eliminating two of the existing window openings, and
WHEREAS, the Board of Fire Commissioners has produced a bid specification package for the proposed work, and
WHEREAS, the Board of Fire Commissioners publicly noticed and invitation to bidders for the window replacement project
