    NOTICE IS HEREBY GIVEN THAT the Board of Trustees of the Village of East Hampton, at a July 29, 2011 meeting, adopted Introductory #4-2011 as LOCAL LAW SIX-2011, hereby adding Chapter 231 (Retail Checkout Bags) to add a prohibition against the provision of plastic checkout bags to customers by establishments engaged in retail sales.

    A Local Law adding Chapter 231 (Retail Checkout Bags) to add a prohibition against the provision of plastic checkout bags to customers by establishments engaged in retail sales.
    BE IT ENACTED by the Board of Trustees of the Village of East Hampton as follows:
    SECTION I. Legislative Intent. The purpose of this Chapter is to improve the environment in the Village of East Hampton by encouraging the use of reusable checkout bags and banning the use of plastic bags for retail checkout of purchased goods. Discarded disposable bags pollute our open spaces and our beaches, harm and kill wildlife and aquatic species, clog storm drains resulting in localized flooding, and end up as debris in our ocean and ponds. Retail establishments are encouraged to make reusable bags available for sale.
    SECTION II. The Code of the Village of East Hampton is hereby amended to add Chapter 231 as follows (text to be added is underlined):
    Chapter 231
    RETAIL CHECKOUT BAGS
    ß231-1. Definitions.
    As used in this article, the following terms shall have the indicated meanings:
    CHECKOUT BAG - means a carryout bag that is provided to a customer at the point of sale. The term checkout bag does not include plastic produce bags or plastic bags measuring 28 by 36 or larger in size.
    PLASTIC PRODUCE BAG - means a flexible container made of very thin plastic material with a single opening that is used to transport produce, meats or other items selected by the customers to the point of sale.
    RETAIL SALES - means the transfer to a customer of goods in exchange for payment occurring in retail stores, sidewalk sales, farmers markets, flea markets and restaurants. The term retail sales does not include sales of goods at yard sales, tag sales, other sales by residents at their home, and sales by non-profit organizations.
    RECYCLABLE PAPER BAG - means a paper bag that should have the following characteristics: (1) contains no old growth fiber, (2) is 100% recyclable overall and contains a minimum of 40% post-consumer recycled content, and (3) displays the words Reusable or Recyclable on the outside of the bag.
    REUSABLE BAG - means a bag with handles that is specifically designed and manufactured for multiple reuse and is (1) made of cloth or other fabric, and/or (2) made of durable plastic that is at least 2.25 mils thick.
    ß231-2. Restriction on Checkout Bags.
    A. Any person engaged in retail sales shall provide only reusable bags and/or recyclable paper bags as checkout bags to customers. Persons engaged in retail sales are prohibited from providing checkout bags to customers.
    B. Nothing in this section shall preclude persons engaged in retail sales from making reusable bags available for sale to customers.
    ß231-3. Operative Date.
    The restriction set forth in ß231-2 shall become operative six months following the date of enactment of the local law adding this article to this chapter, so as to allow retail establishments a period of time within which to dispose of their existing inventory of plastic checkout bags and convert to alternative packaging materials.
    ß231-4. Penalties for Offenses.
    Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $1,000.00 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
    Section IV. SEVERABILITY.
    If any section or subsection, paragraph, clause, phrase or provision of this law shall be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional.
    SECTION V. EFFECTIVE DATE
    This local law shall take effect upon filing with the Secretary of State pursuant to the Municipal Home Rule Law.

    A Local Law amending Chapter 278 (Zoning Code) to clarify that a special permit is required for the construction or installation of any new structures on a lot used for a nonconforming use.
     BE IT ENACTED by the Board of Trustees of the Village of East Hampton as follows:
    SECTION I. Legislative Purpose and Intent. The Comprehensive Plan for the Village of East Hampton favors the elimination of pre-existing nonconforming uses. The Board of Trustees recognizes that an application to make any alterations to a lot upon which a nonconforming use is conducted, including the construction of new buildings or installation of new structures which conform to the Zoning Code in all other respects, presents an opportunity to evaluate whether the nonconforming use may be expanded as a result and whether there is an opportunity for the applicant to reduce or eliminate the nonconforming use in the course of making alterations to the lot. The intent of this local law is to clarify the Code provisions to better reflect existing policy and practice. 
    SECTION II. Chapter 278-3 of the Code of the Village of East Hampton is hereby amended as follows (underlined material is to be added; bracketed material is to be deleted):
    ß278-7. Board of Appeals; variances; special permits; fees.

    D. Special permits.
    (1) The Board of Appeals, as lead agency pursuant to the State Environmental Quality Review Act, upon application after due notice and public hearing, may issue special permits for the following uses which are allowed by special permit only. Any such application for a special permit, with the exclusion of applications involving properties with one-family residential uses only and the buildings or structures related to such uses, shall not be deemed complete, and therefore ready for a public hearing, until the Design Review Board has concluded its preliminary review pursuant to 121 of the East Hampton Village Code.
    The extension or alteration of an existing nonconforming use and the buildings or structures related to such use and the erection of new buildings and structures on any lot used for a nonconforming use, except for the installation of solar panels on an existing roof and the related equipment. However, outdoor dining shall be prohibited in all residential districts on lots used for a preexisting nonconforming use.
    SECTION III. SEVERABILITY.
    If any section or subsection, paragraph, clause, phrase or provision of this law shall be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional.
    SECTION IV. EFFECTIVE DATE
    This local law shall take effect upon filing with the Secretary of State pursuant to the Municipal Home Rule Law.

    The county treasurer has received the tax rolls from the town tax receiver, indicating unpaid taxes therein. Unless such unpaid taxes with interest and accrued penalties are paid on or before Aug. 31, 2011, the property against which said taxes are levied will be advertised for tax sale that is to be held on Dec. 9, 2011.

    RELIEF SOUGHT: A Natural Resources Special Permit (NRSP) pursuant to ß255-4-20 and variances from ß255-4-40 (Minimum wetland setbacks), 255-4-30 (Coastal setbacks) and ß255-3-85 (Coastal Erosion Overlay District regulations).  The following variances are required in this application: (1) & (2) variances of 85  and 62.8  are required to construct the residence and deck 15  and 37.2  respectively from wetlands where a 100  setback is required; (3) & (4) variances of 40  and 53  are required to construct the residence and deck 35  and 22  respectively from the barrier dune crest where a 75  setback is required; (5) a 120  variance is required to construct the sanitary system 30  from wetlands where a 150  setback is required; (6) a variance is required to permit land clearing 10  from a wetland where a 50  setback is required and (7) a variance is required to construct a rock revetment where the
    installation of new coastal erosion structures is prohibited.
