PLEASE TAKE NOTICE that the Trustees of the Freeholders and Commonalty of the Town of East Hampton have temporarily closed the following beach to all vehicles for the period from 5:00 p.m. to 11:00 p.m. on July 4, 2009 (rain date, July 5, 2009): The bay beach lying between the centerline of Barnes Hole Road and the Devon Yacht Club. The beach lying north of the centerline of Barnes Hole Road remains open to vehicles.
Please note that the bay beach lying between the southerly side of Barnes Hole Road and the northerly side of Alberts Landing Road is not a Trustee beach and is subject to the rules and regulations of the Bell Estate Section III property owners’ association. Currently, the association’s rules do not permit vehicles on the beach.
No person shall operate a vehicle within such area during the above hours. Any vehicle parked in that area prior to 5:00 p.m. may remain where parked but no person shall move a previously parked vehicle after 5:00 p.m. and before 11:00 p.m.
This closure shall not apply to the operators of emergency vehicles while actually in the performance of their duties.
The operator of any vehicle being driven within such area during the above hours will be subject to the penalties set forth in the Town Code.
The reason for this temporary closure is the anticipated crowds which will be present on the beach to view the Devon Yacht Club’s annual fireworks show.

DATED JUNE 23, 2009
REGARDING THE TAKING OF SOFT CLAMS IN NAPEAGUE AND THREE MILE HARBORS
The following Resolution was unanimously adopted by the Trustees of the Freeholders and Commonalty of the Town of East Hampton:
WHEREAS, Section 213 10(B) of the Town Code prohibits the taking of shellfish in any manner other than by hand power; and
WHEREAS, Section 213 16(B) of the Town Code prohibits the taking of soft clams between May 1 and August 31 of each year; and
WHEREAS, Section 213 18 of the Town Code recognizes the Trustees’ authority to vary the methods, equipment and permissible dates for the taking of shellfish in such areas as the Trustees shall designate; and
WHEREAS, the East Hampton Town Baymen’s Association has requested that the Trustees authorize the taking of soft clams by holders of Commercial Shellfish Permits from portions of Napeague and Three Mile Harbors by the method known as “churning” or “powering”; and
WHEREAS, in 1993 the Trustees received a similar request and, by Memorandum dated 6/1/93, the East Hampton Town Director of Natural Resources advised the Trustees that “churning” will result in very little impact of a harmful and/or serious nature and that it is quite possible that sets of bivalves in the target area will be enhanced as the “churning” impacts will tend to reduce predator populations (e.g., lady crabs) more than prey, or harvestable, bivalve populations; and
WHEREAS, the Trustees have authorized the taking soft clams by “powering” or “churning” during the summer months on a number of occasions since 1993 and those experiences have demonstrated that “powering” or “churning” is not detrimental to the shellfish population or the environment and is beneficial to the economic well being of those who rely upon town waters for their livelihoods.
NOW, THEREFORE, BE IT RESOLVED 1. Notwithstanding the permissible dates, and methods for the taking of soft clams set forth in Sections 213 10(B) and 213 16(B) of the Town Code, the Trustees hereby designate and approve the following Special Season and Designated Areas for the harvesting of soft clams by the method known as “churning” or “powering” on Mondays, Tuesdays, Wednesdays, Thursdays and Fridays during the period commencing July 1, 2009 and ending September 15, 2009 inclusive: Napeague Harbor:
a) The southwest portion of Napeague Harbor defined as that portion of the Harbor below the low tide line lying southwest of a line extending from the southeast corner of Crassen Boulevard to a point 100 yards east of the Art Barge.
b) The area lying within 500’ south of Hicks Island from the east channel to the west channel. Three Mile Harbor:
a) The area lying within 100’ of the western shore, between Boys Harbor dock and Island Road. 2. Only persons who possess a valid “Commercial License for the Taking of Shellfish from Town Lands” shall be eligible to participate in the special season described in Paragraph 1. The special season shall be subject to such conditions, rules and regulations as the Trustees shall impose thereon. 3. The special season shall authorize the taking of soft clams by the technique known as “churning” or “powering” with a propeller and only on Mondays, Tuesdays, Wednesdays, Thursdays and Fridays between July 1, 2009, and September 15, 2009 during daylight hours only. No other method of taking is authorized. Soft clams may not be taken from any areas other than those specified in Paragraph 1. 4. No person shall take more than three (3) bushels of soft clams per day from the any or all of the areas described in Paragraph 1. All clams so taken shall be placed in either wire or plastic bushel baskets. No person shall possess any quantity of soft clams that do not fit flush within said baskets.†5. Any boat containing soft clams in Napeague or Three Mile Harbors on days when “churning” or “powering” is permitted, shall be subject to inspection by the Trustees or their representative. 6. No vehicle may traverse the Trustee beach surrounding Napeague Harbor west of the line described in Paragraph 1 if it carries more than 1/4 bushel of soft clams, and or transports scoops, baskets, rakes or nets mounted on hoops.
AND BE IT FURTHER RESOLVED, this Resolution shall take effect upon the filing of the same with East Hampton Town Clerk and posting as set forth in Section 213 18 of the Town Code, and shall expire on September 15, 2009.
