HEARING

    NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Incorporated Village of East Hampton will hold a public meeting at the Emergency Services Building, One Cedar Street, East Hampton, New York, on Friday, October 28, 2011, at 11:00 a.m. on the following application and to conduct such other business as may come before the Board:
    Application of Nicholas Grimshaw, SCTM #301-2-2-20, for a Special Permit in accordance with Section 278-7.D. and Area Variances to permit the conversion of an existing three-car garage with workshop into an artist studio with half bath. The existing structure is 600 square feet in gross floor area with a storage loft and is lawfully preexisting and nonconforming with respect to side and rear yard setbacks. Area Variances from Section 278-3.A.(3) are required to permit conversion of the existing garage 0.3 feet from the side yard and 1.8 feet from the rear yard where the required setbacks are 14.37 feet and 22 feet respectively. Area Variances are also required to permit an artist studio of 600 square feet where Section 278-3.D.(1) requires that, except for garages, accessory buildings be limited to one room and 250 square feet. An Area Variance may be required from Section 278-3.D.(3) which requires that accessory buildings, except for garages, not exceed 14 feet in height. The existing garage and a shed total 793 square feet in gross floor area where the maximum gross floor area of Section 278-3.A. limits the gross floor area of all accessory buildings to 2 percent of the lot area plus 200 square feet or 407 square feet. The subject property is located at 10 Pleasant Lane in Residence District R-40 and is 10,354 square feet in area. This is a Type II Action in accordance with SEQR.

(1) and (2) Revocation of a Certificate of Occupancy of the Town Code.  The basis for revocation: (1) Planning Board Approval was previously granted pursuant to 280-a of the Town Law for improvement of private road access but the structures covered by the above certificate of occupancy were not authorized by such 280-a approval, and Planning Board approval was required to amend the 280-a assignment to allow for placement of the structures, (2) Approval from the ARB was not obtained for installation of the structures though such structures meet the requirements for ARB review, (3) The structures are accessory structures  on a separate parcel of property from any principal structure, (4) Evidence has been submitted calling into question applicant s ownership of the premises upon which the structures are erected.

    In April 2012 the Town of East Hampton expects to receive approximately $116,783 in Federal Community Development Block Grant Funds.  These funds may be used, and have been previously used for a variety of projects that benefit low and moderate income persons, aid in the prevention or elimination of slums or blight and/or meet a need having a particular urgency.
    TAKE NOTICE that the Town Board of the Town of East Hampton, will hold a public hearing at the Meeting Room, Town Hall, 159 Pantigo Road, East Hampton, New York, 11937, on November 3, 2011 at 7:00 pm or as soon thereafter as this matter may be heard, to consider citizens’ views on local housing and community development needs to be met with the $116,783 in Federal Community Development Block Grant Funds expected in April of 2012.  These funds may be used, and have been previously used for a variety of projects to be selected by local officials.
    Examples of eligible activities include:

    Elimination of Physical Barriers to the Handicapped
    Public Facilities and Improvements

    NOTICE IS HEREBY GIVEN that by order of the Town Board of the Town of East Hampton, the Town Board will hold a public hearing in the Courtroom, Town Hall, 159 Pantigo Road, East Hampton, NY, on Thursday, November 3,  2011, at 7:00 p.m. or as soon thereafter as this matter be heard, to consider improvements to a private road pursuant to the authority of Section 200 of the Town Law of the State of New York for purposes of improving to Town standards a road consisting of a portion of Pennsylvania Ave. running from Springs-Fireplace Road west approximately 300 feet, to a connecting road having a length of approximately 200 feet and running to a portion of West Drive (north), and a portion of West Drive (north) running from such connecting road in a generally southwesterly direction a distance of approximately 1270 linear feet, for a total roadway length of approximately 1770 feet.     NOTICE IS HEREBY GIVEN THAT THE BOARD OF FIRE COMMISSIONERS OF THE AMAGANSETT FIRE DISTRICT ADOPTED THE FOLLOWING RESOLUTION ON OCTOBER 12, 2011: “RESOLUTION DATED OCTOBER 12, 2011. A RESOLUTION AUTHORIZING THE EXPENDITURE OF UP TO $65,000 FOR THE REPLACEMENT OF 31 WINDOWS IN THE AMAGANSETT FIREHOUSE TO BE PAID OUT OF THE RESERVE FUND.
    WHEREAS the Board of Fire Commissioners of the Amagansett Fire District has determined that it is in the best interests of the residents of the district to replace 31 windows in the Amagansett Firehouse, and
    WHEREAS the Board has heretofore established a general reserve fund containing sufficient funds for the financing of the project.
    NOW, THEREFORE, BE IT RESOLVED that the Board of Fire Commissioners of the Amagansett Fire District hereby authorizes the expenditure of up to $65,000 for the purchase and installation of 31 new windows in the Amagansett Firehouse. Payment for the project shall be made from the reserve fund of the Amagansett Fire District, and be it
    FURTHER RESOLVED, that this Resolution is adopted subject to permissive referendum under Section 6g of the General Municipal Law. This Resolution shall not take effect until 30 days after its adoption nor until approved by the affirmative vote of a majority of the electors of the Amagansett Fire District qualified to vote at an annual election of fire district officers, voting on such proposition, if within 30 days after its adoption there is filed with the undersigned a petition signed and acknowledged or proved in the same manner as a deed to be recorded, by resident taxpayers of said district, owning taxable real property aggregating at least one-quarter of the assessed valuation of all the taxable property of said district as such valuations appear upon the latest completed assessment roll of the Town of East Hampton, protesting against such Resolution and requesting that it be submitted to the qualified electors of the Amagansett Fire District for their approval or disapproval

RESOLUTION
TO DELAY OPENING OF SCALLOP
SEASON IN TRUSTEE
WATERS UNTIL NOVEMBER 21, 2011

    The following Resolution was offered and unanimously adopted:
    WHEREAS ‘213-18 of the Town Code recognizes the Trustees’ authority to vary the permissible dates for the taking of scallops; and
    WHEREAS 213-12 of the East Hampton Town Code permits the taking of scallops from Trustee waters between the third Monday in October and March 31 in each year; and
    WHEREAS, for the year 2011, the State has delayed the opening of scallop season for State waters to November 7, 2011; and
    WHEREAS Trustee waters have traditionally been opened for scalloping two weeks after the opening of State waters.
    NOW, THEREFORE, BE IT RESOLVED that, despite the provisions of  213-12 of the East Hampton Town Code, scallops may not be taken from Trustee waters between 12:01 a.m. on October 17, 2011 and 12:01 a.m. on November 21, 2011. For this year, the season for taking scallops from Trustee waters shall open on November 21, 2011 and end on March 31, 2012, and be it further
    RESOLVED that the reason for this delayed opening is to permit additional time for scallops to spawn, and be it further
    RESOLVED that, except as set forth above, all other provisions of Chapter 213 shall remain in effect, and be it further
    RESOLVED, this Resolution shall take effect upon the filing of same with East Hampton Town Clerk and posting as set forth in 213-18 of the Town Code, and shall expire on November 21, 2011.
