RESOLUTION
TO DELAY OPENING OF SCALLOP
SEASON IN TRUSTEE
WATERS UNTIL NOVEMBER 21, 2011
    The following Resolution was offered and unanimously adopted:
    WHEREAS ‘213-18 of the Town Code recognizes the Trustees’ authority to vary the permissible dates for the taking of scallops; and
    WHEREAS 213-12 of the East Hampton Town Code permits the taking of scallops from Trustee waters between the third Monday in October and March 31 in each year; and
    WHEREAS, for the year 2011, the State has delayed the opening of scallop season for State waters to November 7, 2011; and
    WHEREAS Trustee waters have traditionally been opened for scalloping two weeks after the opening of State waters.
    NOW, THEREFORE, BE IT RESOLVED that, despite the provisions of  213-12 of the East Hampton Town Code, scallops may not be taken from Trustee waters between 12:01 a.m. on October 17, 2011 and 12:01 a.m. on November 21, 2011. For this year, the season for taking scallops from Trustee waters shall open on November 21, 2011 and end on March 31, 2012, and be it further
    RESOLVED that the reason for this delayed opening is to permit additional time for scallops to spawn, and be it further
    RESOLVED that, except as set forth above, all other provisions of Chapter 213 shall remain in effect, and be it further
    RESOLVED, this Resolution shall take effect upon the filing of same with East Hampton Town Clerk and posting as set forth in 213-18 of the Town Code, and shall expire on November 21, 2011.

    BE IT ENACTED by the Town Board of the Town of East Hampton as follows:
    Section I.  Town Code Amended.
    Chapter 220 “Subdivision of Land,” Article XX “Enforcement”, Section 220-4.04 “Right to vary or waive provisions.” is hereby amended to read in its entirety as follows:
    A. Vary. The Planning Board shall have the right to vary the provisions of this chapter in any particular case where, in its judgment, exceptional conditions of terrain or other factors impose undue hardship or practical difficulty, provided that the varying of such provisions:
    (1). Can be done in such a way as to grant relief and at the same time protect the general interest; and
    (2). Does not include Section 220-3.02A(1), 220-3.02F(1) and (4) and 220-3.28,except as otherwise set forth therein or where a reduction of density would result, and provided the result is not inconsistent with the New York State Fire Code and the exemptions, if any, contained therein.    
    B. Waive. The Planning Board shall have the right to waive the provisions of this chapter concerning any particular plat or plats where, in its judgment, such improvements and requirements are not requisite in the interest of the public safety and general welfare, with the proviso that such waiver authority does not include the requirements set forth in Section 220-3.02A(1), 220-3.02F(1) and (4) and 220-3.28, except as otherwise set forth therein, or where a reduction of density would result, and provided the result is not inconsistent with the New York State Fire Code and the exemptions, if any, contained therein
    Section II - Effective Date:
    This local law shall take effect immediately upon filing with the Secretary of State as required by law.

    1. The Montauk Fire Department answer and attend all calls in said Fire District and shall furnish fire protection including fire fighting vehicles and equipment and fire fighting personnel to said District:

    3.  For such services the Montauk Fire Department shall receive and the Town of East Hampton shall pay the sum of $132,581.00 for the calendar year of 2012; $135,233.00 for the calendar year 2013; $137,938.00 for the calendar year 2014; $140,697.00 for the calendar year 2015; and, $143,511.00 for the calendar year 2016.
