    NOTICE IS HEREBY GIVEN THAT the Board of Trustees of the Village of East Hampton will hold a public hearing on the 18th day of November, 2011, at 11:00 a.m. at the Emergency Services Building, One Cedar Street, East Hampton, New York, at which time all persons interested will be heard with respect to “A Local Law amending Chapter 71-4.A, Mass Assemblages, to authorize the Board of Trustees to deny an application for a mass assembly permit where there is a finding that the proposed event would violate any conditions imposed by any Village board or agency in connection with a prior review of an application concerning the same premises or if there are any current violations on the premises or any unsatisfied conditions.

LOCAL LAW NO. __/2011
    A Local Law amending Chapter 71-4.A, Mass Assemblages, to authorize the Board of Trustees to deny an application for a mass assembly permit where there is a finding that the proposed event would violate any conditions imposed by any Village board or agency in connection with a prior review of an application concerning the same premises or if there are any current violations on the premises or any unsatisfied conditions.
    BE IT ENACTED by the Board of Trustees of the Village of East Hampton as follows:
    SECTION I.  Legislative Intent. The purpose of this Local Law is to allow the Board of Trustees the ability to deny a mass assembly permit application if there is a finding that the proposed event would violate any conditions imposed by any Village board or agency in connection with a prior review of an application concerning the same premises or if there are any violations on the premises or unsatisfied conditions.
    SECTION II. The Code of the Village of East Hampton is hereby amended to as follows (added material is underlined; deleted material is bracketed):
    Chapter 71
A    SSEMBLAGES, MASS
    ß71-1. Definitions.
    As used in this chapter, the following terms shall have the meanings indicated:
    LARGE ASSEMBLY OF PERSONS 
    A. Any group of 50 or more persons engaged in a meeting, social activity, sports event, fund-
    raising event or similar gathering where one or more of the following conditions exist:
    (1) The parking of vehicles of those in attendance is on a public road or a public place.
    (2) Accumulation of refuse or litter beyond that normally provided for on the premises
    where the large assembly is taking place.
    B. Notwithstanding the above, people gathered at a religious institution, theater, museum or school shall not constitute a large assemblage of persons .
    ß71-2. Permit required.
    Any person, corporation, association or other entity proposing to hold a large assemblage of persons shall be required to obtain a permit from the Incorporated Village of East Hampton. Application for a permit shall be made on a form prescribed by the Village of East Hampton and shall be submitted to the Village Administrator.
    ß71-3. Regulations.
    A. The application form shall request the following information:
    (1) The name, address and telephone numbers of applicants who shall be responsible for and personally be in attendance at the large assemblage.
    (2) The location of the property.
    (3) The approximate number of persons expected.
    (4) The date upon which the large assemblage is to take place and the hours between which it is to take place.
    (5) An indication of available parking. Legal parking for expected cars shall be deemed one car for each two persons attending such assemblage. It shall be noted if an attendant is to be provided. During the event, parked vehicles shall not block driveways or fire hydrants, and vehicles must be parked off the paved portion of all streets in the same direction as the flow of traffic.
    (6) Facilities for the collection, storage and disposal of garbage, refuse and debris.
    (7) The name, address, phone number and contact person for the caterer of the event, if any.
    B. No fee shall be required.
    C. The application form shall be submitted to the Village Administrator no less than 21 days before the date of the expected assemblage.
    D. All application forms must be accompanied with an executed release of all claims against the Village of East Hampton arising from the event and an agreement to hold the Village harmless and indemnify it from any damages, in a form acceptable to the Village Administrator.
    E. [Note: Former Subsection E, regarding general liability insurance, was repealed 5-18-2007 by L.L. No. 6-2007.]
    ß71-4. Issuance of permit.
    A. A permit may be issued by the Village Board of Trustees, or the Village Administrator as its designee, or it may be denied by the Village Board of Trustees upon a finding that the application was not timely submitted, or that the required information and/or indemnification and insurance forms were not submitted, or that insufficient arrangements have been made to control parking, traffic, noise, lighting or refuse, or that the event will conflict with other events that may overtax police and other emergency services or that the proposed event would violate zoning or any conditions related to a subdivision, site plan or special permit approval by the Planning Board or Zoning Board of Appeals or that there are outstanding violations on the property at which the special event will be held or any outstanding or unsatisfied conditions imposed by the Planning Board or the Zoning Board of Appeals, or any other Village agency or department on such property or any other property owned or leased by the applicant.
    B. The permit may be subject to reasonable conditions, which shall be stated in writing on the permit, related to traffic, parking, litter and garbage, noise, and possible damage to public property. Whether or not so stated in the permit, the issuance of the permit obligates the applicant to obtain all other governmental permits, if any, that may be required.
    C. The permit must be kept available on the premises during the event, available for inspection by a police officer or other code enforcement officer of the Village of East Hampton upon request of such officer. Such officers may inspect the premises subject to the permit in order to ensure compliance with the conditions of the permit.
    D. The applicant shall ensure that the gathering is held in conformance with the permit and shall be responsible for preventing those attending the gathering from trespassing on any adjoining premises.
    ß71.5 Penalties for offenses.
    Any person or entity who fails to comply with any provision of this chapter, including but not limited to the failure to obtain a permit prior to the holding of a gathering for which a permit is required or the failure to comply with its conditions, shall be guilty of a violation and shall, upon conviction, be subject to a fine of not more than $250 for each separate violation.
    Section IV. SEVERABILITY.
    If any section or subsection, paragraph, clause, phrase or provision of this law shall be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional.
    SECTION V. EFFECTIVE DATE
    This local law shall take effect upon filing with the Secretary of State pursuant to the Municipal Home Rule Law.
