    NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Incorporated Village of East Hampton will hold a public meeting at the Emergency Services Building, One Cedar Street, East Hampton, New York, on Friday, May 13, 2011, at 11:00 a.m. on the following applications and to conduct such other business as may come before the Board:
    Application of Vincent Chiavarone Builders LLC and J. Mart Realty LLC, SCTM # s 301-1-6-7 and 1-6-8, for Area Variances from the requirements of Section 278-3.A.(2), Front Yard Setbacks, and Section 278-3.A.(3), Side and Rear Yard Setbacks, to allow subdivision of the property wherein the proposed lots will complement the existing development pattern along Newtown Lane and 25% of the total area will be set aside as open space. Proposed Lots 1, 2, and 4 contain existing residences and accessory structures and require the following relief: Lot 1 is proposed to be 28,745 square feet in area and has frontage on both Newtown Lane and Race Lane. The existing residence is 19.4 feet from the front lot line along Newtown Lane where the required setback is 35 feet. The residence and an accessory structure are 7.8 feet and 16.7 feet respectively from the westerly lot line where the required rear yard setback is 20.16 feet. A Variance from Section 278-3.A.(3) is requested to permit a front yard setback from Race Lane of 20.16 feet where 30.24 feet is required. Lot 2 is proposed to be 28,366 square feet in area and contains an existing residence 12.2 feet from the front property line along Newtown Lane where the required setback is 35 feet and is 18.2 feet from the easterly property line where the required side yard setback is 19 feet. Lot 4 is proposed to be 32,408 and contains an existing residence and accessory structures. A Variance from Section 278-3.A.(2) is requested to permit a setback of 35.6 feet from Newtown Lane where the required front yard setback is 40 feet. The residence and an accessory structure are 20.7 feet and 17.9 feet respectively where the required side yard setback is 21.91 feet. The proposed subdivision is located at 153 Newtown Lane and 147 Newtown Lane in Residence District R-40. This project is classified as an Unlisted Action in accordance with SEQR.
    Application of Eric and Lori Blatstein, SCTM #301-13-10-13, for Area Variances to allow reconfiguration of existing walks and patios and extension of the existing pool patio 1.6 feet from the northerly property line where the required side and rear yard setback of Section 278-3.A.(3) is 24 feet. An Area Variance may be required to allow 6,311 square feet of coverage where the maximum coverage permitted by Section 278-3.A.(6) is 5,579 square feet. Portions of the existing walks and patio are preexisting and nonconforming with respect to required side and rear yard setbacks (patio and walks proposed to be removed are 3.2 feet from the easterly property line) and lot coverage (existing coverage is 6,343 square feet). The subject property is 26,459 square feet in area and is located at 73 Ocean Avenue in Residence District R-160. The property is located in the Ocean Avenue Historic District as regulated by Chapter 176  Preservation of Historic Areas, of the Village Code and adjoins contributing properties of the East Hampton Village Historic District as listed on the National Register of Historic Places. This project is classified as a Type II Action in accordance with SEQR.

    Proposals will be received until June 1 at 10:00 a.m. at the Administrative Offices, 48 School Street, East Hampton, New York 11937 at which time and place all proposals will be publicly opened.  Specifications and proposal forms may be obtained at the same office in person or by request made to Ms. Fran Silipo, District Clerk, at 631-324-0144.  Deviations from the conditions or specifications shall be listed on a separate sheet attached to the proposal form and referenced separately in the proposal.  In all cases where proposers do not indicate a deviation, it is understood that the conditions and specifications of the School District shall apply. Proposals shall remain firm for a period of forty-five (45) days following the date of the opening of proposals.  The Board of Education reserves the right to waive any informalities in or to reject any or all proposals, or to accept that proposal which, in the Board of Education’s judgment, is in the best interest of the School District. The Board of Education reserves the right to consider experience, service and reputation in the above-referenced fields.  In addition, the Board of Education reserves the right to consider the financial responsibility and specific qualifications, as set out herein, of the prospective proposer in its evaluation of the proposals and award of the contracts.

     Shall the Board of Education be authorized to transfer funds from its fund balance for the 2010-11 school year to its repair reserve, and thereafter annually up to $150,000 from existing fund balance to its repair reserve for repairs to facilities and equipment of a type that does not recur annually or at shorter intervals; which transfer of funds shall not cause an increase in taxes.
    To authorize the Board of Education to enter into a new tuition agreement with East Hampton Union Free School District  for the 2011-12 through 2014-15 school years for the education of Springs Union Free School District 9th through 12th grade students, which agreement shall supersede the existing tuition agreement between the school districts that was authorized by the voters at the May 20, 2008 annual election and budget vote, representing a cost savings to be realized by the Springs School District of approximately $3,244,00.00 over the duration of the new agreement.
    PLEASE TAKE FURTHER NOTICE that a copy of the statement of the amount of money which will be required to fund the School District s Budget for 2010-11, exclusive of public monies, may be obtained by any interested person in the district between the hours of  8:00 a.m. and 4:00 p.m., beginning May 3, 2011 except Saturday, Sunday, and holidays, at the Business Office at Springs School, located at 48 School Street, Springs, East Hampton, N.Y.
    PLEASE TAKE FURTHER NOTICE that nominations for the office of member of the Board of Education shall be filed between the hours of  8:00 a.m. and 4:00 p.m. with the Clerk of said School District at that office in the Springs School, Springs, East  Hampton, New York, not later than April 18, 2011 at 5:00 p.m.  Vacancies on the Board of Education shall be considered separate, specific offices and nominating petitions shall describe any specific vacancy for which a candidate is nominated.  Such petition must be directed to the Clerk of the District; must be signed by at least twenty-five (25) qualified voters of the District; must state the name and residence of the candidate; must state the home and residence of each signer and must describe the specific vacancy for which the candidate is nominated, including the name and the length of the term of office of the last incumbent.  Sample board candidate petitions and information for this election will be available in the office of the District Clerk on any day when the school is open between the hours of  8:00 a.m. and 4:00 p.m.
    PLEASE TAKE FURTHER NOTICE that personal registration of voters is required either pursuant to 2014 of the Education Law or Article 5 of the Election Law. If a voter has heretofore registered pursuant to 2014 of the Education Law and has voted at any annual or special district meeting within the last four (4) years, or if he or she is eligible to vote under Article 5 of the Election Law, he or she is also eligible to vote at this election.  All other persons who wish to vote must register.
    The register of voters prepared by the District pursuant to Section 2014 of the Education Law and the registration list prepared by the Board of Elections of Suffolk
County will be filed in the office of the Clerk of the School District in the Springs School,
48 School Street, Springs, East Hampton, New York, and will be open for inspection by any qualified voter of the District between the hours of  8:00 a.m. and 4:00 p.m. on and
after May 12, 2011, and on each day prior to the date set for the Annual Meeting and Election, except Sunday, and at the polling place on the day of the vote.
    Qualified voters who wish to register may also do so at the District Office, Springs School, 48 School Street, Springs, East Hampton, New York, when the school is open between the hours of 8:00 a.m. and 4:00 p.m., provided he or she registers at least five (5) days before the Annual Election. Those who wish to register must be primary residents of the Springs UFSD.
    PLEASE TAKE FURTHER NOTICE that pursuant to the provisions of  2014 of the Education Law, the Board of Registration will meet on Tuesday, May 17, 2011, at the Springs School, 48 School Street, Springs, East Hampton, New York between the hours of 1:00 p.m. and 9:00 p.m., at the Springs School, to prepare the register of the School District to be used at meetings or elections held subsequent to the Election.  Any person qualified will be entitled to have his or her name placed on such register, provided that at such meeting of the Board of Registration he or she is known or proven to the satisfaction of the Board of Registration to be then or thereafter entitled to vote at such school district election for which said register is so prepared.
    PLEASE TAKE FURTHER NOTICE that Absentee Ballots are available for the election of members of the Board of Education and for the adoption of the annual budget and referenda in accordance with 2018-a of the Education Law.  Applications for absentee ballots can be obtained from the District Clerk. Completed applications must be received by the District Clerk at least seven (7) days before the Annual Election if the ballot is to be mailed to the voter, or the day before the Annual Election, if the ballot is to be picked up personally by the voter. Absentee Ballots must be received by the District Clerk no later than 5:00 p.m. on May 17, 2011.
    A list of persons to whom absentee ballots are issued will be available to qualified voters of the district in the office of the District Clerk on and after May 12, 2011, between the hours of  8:00 a.m. and 4:00 p.m., on weekdays prior to the day set for the Annual Election.
    PLEASE TAKE FURTHER NOTICE that pursuant to a rule adopted by the
Board of Education in accordance with Section 2035 of the Education Law, any questions or propositions to amend the budget or otherwise to be submitted for voting at said annual election must be filed with the Board of Education at the Springs School, 48 School Street, Springs, East Hampton, N.Y., no later than April 18 at 4:00 p.m., and must be typed or printed in the English language, must be directed to the clerk of the school district and must be signed by at least one hundred (100) qualified voters of the school district.  However, the School Board will not entertain any petition to place before the voters any proposition which is not within the powers of the voters to determine, nor any proposition that fails to include a specific appropriation where the expenditure of monies is required by the resolution, nor any proposition or amendment which is contrary to law.
    PLEASE TAKE FURTHER NOTICE that a Real Property Tax Exemption Report prepared in accordance with Section 495 of the Real Property Tax Law will be annexed to any tentative/preliminary budget as well as the final adopted budget of which it will form a part, and shall be posted on District bulletin board(s) maintained for public notices, as well as on the District s website.
