    A Local Law amending ß267-15 of the Code of the Village of East Hampton; Vehicle and Traffic; Penalties for Offenses to increase the minimum fine to $80 for violation of non-beach parking regulations and increase the minimum fine to $150 for violation of the beach parking permit requirements.
    BE IT ENACTED by the Board of Trustees of the Village of East Hampton as follows:
    SECTION I.  The provisions of ß267-15 of the Code of the Village of East Hampton are hereby amended as follows:
    ß267-15. Vehicle and Traffic; Penalties for offenses.
    B. All persons cited on a Village parking summons for a violation of the parking permit requirements of this chapter as set forth in ߆267-5 (Beach parking) shall be subject to a minimum fine of  $150 and shall answer and/or appear on or  before the designated return date.
    C. All persons cited on a Village parking summons for a vehicle-related or other violation of this chapter, other than as set forth in Subsection B above, shall be subject to a minimum fine of  $80 and  shall answer and/or appear on or before the designated return date.
    SECTION II.  SEVERABILITY.
    If any section or subsection, paragraph, clause, phrase or provision of this law shall be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional.
    SECTION III.  EFFECTIVE DATE
    This local law shall take effect upon filing with the Secretary of State pursuant to the Municipal Home Rule Law.

    A Local Law amending Chapter 211 (Peace and Good Order) to prohibit smoking in certain public places.
    BE IT ENACTED by the Board of Trustees of the Village of East Hampton as follows:
    SECTION I.   Legislative Purpose and Intent.   The United States Environmental Protection Agency has determined that secondhand tobacco smoke is a Class A carcinogen.  The smells caused by those who smoke tobacco products and the litter caused by those who improperly dispose of cigarette butts can significantly reduce the enjoyment for those individuals and families that want to enjoy a healthy environment free of smoking-related pollution.  The Board of Trustees of the Village of East Hampton thereby finds it appropriate to enact prohibitions against smoking in certain outdoor facilities frequented by families, including children.
    SECTION II.  Chapter 211 of the Code of the Village of East Hampton is hereby amended as follows:
    ß211-17.  Smoking in public places.
    No person shall smoke a cigarette, pipe, cigar or similar smoking substance at or within the following public park areas:
    A. Within 50 feet of any of the playground apparatus or equipment located at Herrick Park.
    B. On the deck of the Main Beach Pavilion, including the concession stand and related improvements (shower areas, ramps, cabanas).
    SECTION III.  SEVERABILITY.
    If any section or subsection, paragraph, clause, phrase or provision of this law shall be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional.
    SECTION IV.  EFFECTIVE DATE
    This local law shall take effect upon filing with the Secretary of State pursuant to the Municipal Home Rule Law.

beach parking permits for a daily fee, which is to paid to the parking lot attendant in return for a receipt stub to be displayed on the dashboard, limited to Monday thru Friday, excluding holidays at Two Mile Hollow Beach. At Main Beach, daily parking will be available Monday thru Friday.  In addition, at Main Beach only, daily parking will be available Saturdays, Sundays and holidays for not more than twenty-five vehicles.
    SECTION II.   Chapter 267 of the Code of the Village of East Hampton is hereby amended as
follows:
    ß267-5. Vehicle and Traffic; Beach parking.
    D. Limited Daily Parking Available by Fee for Non-Permit Holders.
    Daily parking is available on a limited basis for individuals not possessing a beach
parking permit at a daily fee,  which shall, from time to time, be fixed by resolution of the Board of Trustees.  Daily parking is available at the following beaches and days stated:
    (1) Main Beach - village-owned parking lot adjoining the easterly side of Ocean Avenue: on Monday thru Friday.  In addition, daily parking will be available Saturdays, Sundays and holidays for not more than twenty-five vehicles.
    (2) Two Mile Hollow Beach Parking Lot: Monday thru Friday, excluding holidays.
    SECTION II.  SEVERABILITY.
    If any section or subsection, paragraph, clause, phrase or provision of this law shall be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional.
    SECTION III.  EFFECTIVE DATE
    This local law shall take effect upon filing with the Secretary of State pursuant to the Municipal Home Rule Law.
