    A revision of Local Law providing for better enforcement of that law.
    BE IT ENACTED by the Town Board of the Town of East Hampton as follows:
    SECTION I. - FINDINGS AND OBJECTIVES:
    The Town enacted legislation requiring licensing for taxicabs, adopted June 17, 2010.  The Town allowed for an extended period to allow an increased time period for taxicab operators to come into compliance and for law enforcement officials to troubleshoot enforcement issues.  During that time many operators came into compliance.  However, the Police Department found enforcement difficult in high volume situations.  The Department had difficulty enforcing because it required additional time, resources, and man-power to investigate each vehicles function on-scene.  Vehicles functioning as liveries were exempted and therefore not subject to enforcement.  Therefore, the Department suggested eliminating the exemption for livery vehicles.  As a result, all vehicles would need to comply and no on-scene investigation into that threshold matter would be needed.  The Town Board finds the Police Department’s analysis convincing.
    SECTION II - LOCAL LAW AMENDED
    A. Section 226-3(G) “Exemptions” is hereby amended to now remove “Liveries, as defined in ? 226-2 herein.”
    B. Section 226-3(G) “Exemptions is hereby repealed to now read as follows:
    G. Reserved.
    SECTION III - SEVERABILITY
    If any section, provision, or part thereof in this section shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the section as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
    SECTION IV. - EFFECTIVE DATE:
    This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

    Chapter 255 (Zoning) Section 255-11-64 “Uses Prohibited in Single-Family Residences” is hereby amended to read as follows:
    G. Parking. When in use pursuant to Section 255-11-62D hereof, parking of vehicles of occupants and their visitors on the street or on any property other than the lot on which the residence is located or parking overnight of more than four vehicles on said lot. A violation of the provisions of this section shall be punishable by a fine of not less than $250 nor more than $1,000 or by imprisonment not to exceed six months, or both.
    SECTION II. EFFECTIVE DATE
    This local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

    TAKE NOTICE, that a public hearing will be held before the East Hampton Town Planning Board at Town Hall, 159 Pantigo Road, East Hampton, on Wednesday, July 13, 2011, at 7:00 p.m. or as soon thereafter as this matter may be heard, to consider the application of IGA Concrete Slabs Site Plan/Special Permit approval pursuant to Articles V and VI of Chapter 255 of the East Hampton Town Code, to expand the existing one-story supermarket by 5,223 square feet and to construct concrete slabs for shipping and receiving, a 10  x 12  outdoor refrigerator, generator and shopping carts. The property consists of four lots to be merged into one multiple business complex.  Lot 24 (post office) contains 0.287 acre, Lot 25 (parking strip) contains 0.129 acre, Lot 26 (IGA) contains 2.00 acres, and Lot 27 (retail) contains 0.437 acre.  Five (5) truck spaces and 147 parking spaces including six (6) handicapped spaces are proposed.
