A Local Law adding Chapter 231 (Retail Checkout Bags) to add a prohibition against the provision of plastic checkout bags to customers by establishments engaged in retail sales.
BE IT ENACTED by the Board of Trustees of the Village of East Hampton as follows:
SECTION I. Legislative Intent. The purpose of this Chapter is to improve the environment in the Village of East Hampton by encouraging the use of reusable checkout bags and banning the use of plastic bags for retail checkout of purchased goods. Discarded disposable bags pollute our open spaces and our beaches, harm and kill wildlife and aquatic species, clog storm drains resulting in localized flooding, and end up as debris in our ocean and ponds. Retail establishments are encouraged to make reusable bags available for sale.
SECTION II. The Code of the Village of East Hampton is hereby amended to add Chapter 231 as follows (text to be added is underlined):
RETAIL CHECKOUT BAGS
As used in this article, the following terms shall have the indicated meanings:
CHECKOUT BAG - means a carryout bag that is provided to a customer at the point of sale. The term checkout bag does not include plastic produce bags or plastic bags measuring 28 by 36 or larger in size.
PLASTIC PRODUCE BAG - means a flexible container made of very thin plastic material with a single opening that is used to transport produce, meats or other items selected by the customers to the point of sale.
RETAIL SALES -means the transfer to a customer of goods in exchange for payment occurring in retail stores, sidewalk sales, farmers markets, flea markets and restaurants. The term retail sales does not include sales of goods at yard sales, tag sales, other sales by residents at their home, and sales by non-profit organizations.
RECYCLABLE PAPER BAG - means a paper bag that should have the following characteristics: (1) contains no old growth fiber, (2) is 100% recyclable overall and contains a minimum of 40% post-consumer recycled content, and (3) displays the words Reusable or Recyclable on the outside of the bag.
REUSABLE BAG -means a bag with handles that is specifically designed and manufactured for multiple reuse and is (1) made of cloth or other fabric, and/or (2) made of durable plastic that is at least 2.25 mils thick.
ß231-2. Restriction on Checkout Bags.
A. Any person engaged in retail sales shall provide only reusable bags and/or recyclable paper bags as checkout bags to customers. Persons engaged in retail sales are prohibited from providing checkout bags to customers.
B. Nothing in this section shall preclude persons engaged in retail sales from making reusable bags available for sale to customers.
ß231-3. Operative Date.
The restriction set forth in ß231-2 shall become operative six months following the date of enactment of the local law adding this article to this chapter, so as to allow retail establishments a period of time within which to dispose of their existing inventory of plastic checkout bags and convert to alternative packaging materials.
ß231-4. Penalties for Offenses.
Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $1,000.00 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
Section IV. SEVERABILITY.
If any section or subsection, paragraph, clause, phrase or provision of this law shall be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional.
SECTION V. EFFECTIVE DATE
This local law shall take effect upon filing with the Secretary of State pursuant to the Municipal Home Rule Law.

SECTION I. TOWN CODE AMENDED:
Chapter 156 (Home Improvement Contractors) Section 156-5 “Definitions” is hereby amended to read as follows:
Sec. 156-5 Definitions.
HOME IMPROVEMENT CONTRACTOR
Any person who carries out, engages in, undertakes or holds himself out to others as performing or available to perform one or more home improvements, or any person providing management or construction administration services to an owner for one or more home improvements, as defined herein. For the purposes of this chapter, home improvement contractors shall include, but not be limited to, audio/visual contractors, drywall/sheetrock contractors, electricians, plumbers, exterminators, heating ventilating and air conditioning contractors, property/estate watchers, landscapers, landscape contractors, masons, kitchen and bath renovators, swimming pool maintenance and repair contractors, modular home contractors, and solar/wind energy contractors. Any individual or corporation hired as a subcontractor, as defined herein, shall be required to obtain and maintain a valid Home Improvement Contractor License as issued by the Town Clerk of East Hampton.
Chapter 156 (Home Improvement Contractors) Section 156-10 “License Required” is hereby amended to read as follows:
Sec. 156-10 License required.
No person shall conduct, undertake or engage in any home improvement, as the same is defined herein, without first obtaining and thereafter maintaining in effect at all times an East Hampton Town home improvement contractor’s license from the Town Clerk as herein provided. Such license or a copy thereof shall be available at all of the contractor’s work sites and shall be produced to any official having jurisdiction upon demand.
Chapter 156 (Home Improvement Contractors) Section 156-11 “Exceptions” is hereby amended to read as follows:
Sec. 156-11 Exceptions.
D. Architects and professional engineers who are acting exclusively within the scope of the profession for which he or she is currently certified or licensed.
Chapter 156 (Home Improvement Contractors) Section 156-13 “Application for license” is hereby amended to read as follows:
Sec. 156-13 Application for license.
C. Applicants for a Home Improvement Contractors License shall furnish a valid government or employer issued form of picture identification at time of application or renewal.
D. First time applicants seeking a home improvement contractor’s license shall provide proof of five classroom hours of continuing education within one year prior to initial application. Such continuing education shall be provided by a recognized training facility such as an accredited college or university providing construction or construction-related courses towards a construction-related degree or courses provided by the National Association of Home Builders (NAHB) or certified safety courses approved by the Occupational Safety and Health Administration (OSHA) or be otherwise approved by the Building Inspector as suitable for continuing education credits. The Building Inspector will maintain a list of continuing education courses that he has determined qualify as educational credit for licensee’s review.
Chapter 156 (Home Improvement Contractors) Section 156-14 “Application for renewal license” is hereby amended to read as follows:

Applicants for a renewal license shall provide all of the information required by Section 156-13 above.
Chapter 156 (Home Improvement Contractors) Section 156-15 “Change in information” is hereby amended to read as follows:
Sec. 156-15 Change in information.
A licensee shall notify the Town Clerk in writing of any change in any information required pursuant to Section 156-13 (Application) or 156-14 (Renewal) which was provided to the Town on its application for a license or a renewal license, within 30 days of any such change.
Chapter 156 (Home Improvement Contractors) Section 156-21 “Denial of license” is hereby amended to read as follows:
Sec. 156-21 Denial of license; appeals.
The Town Clerk shall notify the applicant of any denial of an application for a license or renewal. Such notice shall be in writing, shall be served on the applicant personally or by certified mail and shall specify the ground(s) for the denial. The notice shall be accompanied by a statement that the applicant may request an appeal hearing before the Licensing Review Board by submitting a written request therefor within 20 days. The procedure to be followed by the Licensing Review Board shall be as set forth in Section 156-30 hereof.
Chapter 156 (Home Improvement Contractors) Section 156-22 “Nature and use of license” is hereby amended to read as follows:
Sec. 156-22 Nature and use of licenses.
E. Posting and display. A license issued hereunder shall at all times be posted conspicuously in the place of business (or commercial vehicle if there is no other place of business) of the licensee, and such license or a copy thereof shall be produced for any owner upon demand. A copy of the home improvement license for all individuals and/or corporations, including any and all subcontractors, engaging in the home improvement business shall be posted at each worksite within the Town of East Hampton and shall be available for inspection and shall be produced upon demand of any Town official.
F. Upon approval of an application, the Town Clerk shall issue a vehicle identification sticker for each vehicle associated with the home improvement contractor business, which shall be attached to the upper left rear exterior windshield of the vehicle and shall be kept clear and readable at all times. Failure to post and maintain such current sticker shall be a violation of this chapter.
(1) Fee to be paid for vehicle identification sticker.
(a) The Town Board shall by resolution establish a fee to be paid by licensee for each vehicle identification sticker requested by same. The Town Board may, from time to time by resolution, amend the fee for obtaining the vehicle identification fees established by this section.
G. Report of changes. Every licensee shall, within 10 days after a change of control, ownership or management, change of trade name or change of address, notify the Clerk, in writing, of such change.
H. Zoning. The holder of any home improvement contractor’s license issued under this chapter agrees that, as an additional condition of the issuance of said license to operate within the Town of East Hampton, he or she shall plan, execute and complete all home improvements in strict compliance with the terms of the East Hampton Town Zoning Code then in effect, as well as any and all permits and/or conditions of approval issued by any federal, state and/or local agency.
SECTION II. EFFECTIVE DATE
This local Law shall take effect on January 1, 2012 and upon filing with the Secretary of State as provided by law.
