On Father’s Day, Sag Harbor Village police arrested an unlicensed East Hampton man, 25, whom they accused of driving while intoxicated with a 4-year-old child standing up in the back seat. Erik T. Aguilar was charged with felony-aggravated D.W.I. under Leandra’s Law, a state law that makes the charge an automatic felony when a passenger 15 years old or younger is in the car.
Mr. Aguilar was driving a Honda Accord west on Bay Street at about 10:15 a.m. and making a left turn onto Main Street when police spotted the child standing up and with no child restraints. They stopped the car in the Meadow Street parking lot and found the driver to be intoxicated. He reportedly performed poorly on several field sobriety tests before being placed under arrest. His blood was drawn at headquarters to test his blood-alcohol level.
In addition to the felony, Mr. Aguilar was also charged with endangering the welfare of a child, a misdemeanor, and several violations, including having a child in the car without a seatbelt and driving without a license. The child’s mother picked him up at headquarters; Mr. Aguilar was held overnight.
Justice Lisa R. Rana, who sits in both Sag Harbor Village and East Hampton Town justice courts, arraigned Mr. Aguilar in East Hampton on Monday. He is being held at the Suffolk County jail in lieu of $5,000 bail.
In Amagansett, an 18-year-old driving a 2002 Porsche Carrera struck a tree on Saturday afternoon and was charged with misdemeanor D.W.I. Police said the Manhattan teen, whose name was not released because he is eligible for youthful offender status, was heading north at about 3:15 p.m. on Old Stone Highway in Amagansett when he lost control of the Porsche and hit a tree near Winding Way. Police found he had only a learner’s permit, not a driver’s license.
He was charged with misdemeanor D.W.I. and released on an appearance ticket at Stony Brook Southampton Hospital, where he was taken for evaluation of injuries. An 18-year old female passenger also complained of pain and was treated at the hospital.
Gabriel R. Hale, 31, of Apollo Beach, Fla., was charged with D.W.I. following an accident just after midnight Sunday. Mr. Hale was behind the wheel of a 2005 Land Rover headed south on Springs- Fireplace Road, near Hartley Boulevard in Springs, when he rear-ended a 2009 Toyota driven by Noemi Targelia Pillco. Ms. Pillco told police the Land Rover had made a U-turn and left the scene.
Police found it parked in a driveway on Banks Court, East Hampton, with Mr. Hale asleep in the driver’s seat. He showed signs of intoxication and was arrested at about 1:30 a.m.
Justice Rana arraigned him later that morning and released him on his own recognizance. No one was injured in the accident.
