NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Incorporated Village of East Hampton will hold a public meeting at the Emergency Services Building, One Cedar Street, East Hampton, New York, on Friday, September 9, 2011, at 11:00 a.m. on the following applications and to conduct such other business as may come before the Board:
Application of Steven and Carolyn Kotler, SCTM #301-13-12-1, for an Area Variance to allow construction of a pergola (approximately 32 feet long, 5 feet deep, and 12 feet high) to be located 27.2 feet from the rear property line where the required setback of Section 278-3.A.(3)(a) is 34 feet. The subject property is 73,027 square feet in area and is located at 123 Lily Pond Lane in Residence District R-160. Adjoining properties are located in the East Hampton Village Historic District as listed on the National Register of Historic Places but are not subject to the requirements of Chapter 176 of the Village Code, Preservation of Historic Areas. This is a Type II project in accordance with SEQR.
Application of Guild Hall of East Hampton, SCTM #301-8-5-3, for a Special Permit and Area Variances in order to allow the installation of an 8 foot by 8 foot storage shed. A Special Permit in accordance with the provisions of Section 278-7.D. is required for the extension or alteration of an existing nonconforming use and the buildings or structures related to such use, including the erection of new nonconforming buildings and structures. An Area Variance is required from Section 278-3.A.(6) of the Village Code in order to permit the existing coverage of 28,657 square feet to be increased to 28,721 square feet, inclusive of driveways and parking areas, where the maximum permitted coverage is 9,670 square feet. Additionally, Area Variances from the required Transitional Yard Setback of Section 278-3.E. of 32 feet [twice the setback of the adjoining residential property as determined by Section 278-3.A.(3)(b)] and the required rear yard setback of Section 278-3.A.(3) of 34 feet are required to permit the storage shed to be located 24 feet from the rear property line. The subject property is 45,848 square feet and is located at 158 Main Street in Residence District R-80. This property is located in the Main Street Historic District and is subject to the provisions of Chapter 176, Preservation of Historic Areas and is a contributing property of the East Hampton Village Historic District as listed on the National Register of Historic Places. This project is classified as a Type II Action in accordance with SEQR.
Application has been made by Bayberry Close Corporation, SCTM #301-13-13-20.2, for a Special Permit and Area Variances to allow the renovation, extension, and alteration of one of ten units that constitute a preexisting nonconforming use as a residential cooperative. The gross floor area of Cottage #2 is proposed to be increased from 727 square feet to 983 square feet in area and 139.6 square feet of patio. Additionally, Area Variances from the Transitional Yard Setback of Section 278-3.E of 68 feet, the required front setback of Section 278-3.A.(2) of 70 feet, and the required side yard setback as set forth in Section 278-3.A.(3) of 50 feet are required to allow the proposed 256 square foot addition to be 30.8 feet from the front property line and 40.8 feet from the side property line; the 77.6 square foot patio on the southeast side of the unit to be 25.2 feet from the front property line and approximately 34 feet from the side property line; and the 62 square foot patio on the southwest side of the unit to be 46 feet from the front property line and approximately 40 feet from the side property line. The proposed improvements are landward of the Coastal Erosion Hazard Line. The subject property is located at 92 Ocean Avenue and consists of 2.489 acres in Residence District R-160 which permits one dwelling on a minimum lot size of 160,000 square feet (3.673 acres). This property adjoins the East Hampton Village Historic District and is a contributing property in the Ocean Avenue Historic District as regulated by Chapter 176 of the Village Code, Preservation of Historic Areas. This is a Type I Action in accordance with SEQR.

BE IT ENACTED by the Town Board of the Town of East Hampton as follows:
Section I. Town Code Amended.
Section 255-6-76. Validity of approval; phased site plan approval.
Amend:
A. Time for obtaining a building permit. A site plan approval shall be valid for a period of six months three years from the date on which the Chairman certifies that all conditions of the site plan approval have been met, pursuant to section 255-6-20, Subsection B, hereof. The Planning Board may by resolution extend the approval for one an additional period of six months one year without the need for a new public hearing.
B. Phased site plan approval. Notwithstanding anything to the contrary in Subsection A above, the Planning Board may issue a phased or staged site plan approval in which a building permit may be issued for certain improvements more than six months three years from the initial date of certification of the approval by the Chairman. A building permit for the final phase or stage of such a project shall, however, be obtained no later than five years from the date of the Board’s resolution of approval.

Section 255- 8-85. Validity of Zoning Board of Appeals’ Determination.
Time for obtaining a building permit. A determination from the Zoning Board of Appeals shall be valid for a period of three years from the date on which the Board certifies that all conditions of the determination have been met. The Zoning Board of Appeals may by resolution extend the determination for an additional period of one year without the need for a new public hearing.
Amend:
Section 102-8. Performance of work under building permit.
A. A building permit shall be effective to authorize the commencing of work in accordance with the application, plans and specifications on which it is used for a period of six months one year after the date of its issuance. For good cause, the Building Inspector may allow a maximum of two extensions for periods not exceeding three months each. The extension may be for either a period not exceeding six months each or a period not exceeding one year each.

PURSUANT TO PERMISSIVE

TAKE NOTICE that at a meeting of the Town Board held on the 18th day of August, 2011, the Town Board adopted a resolution, subject to permissive referendum, award a lease for premises at 328 Accabonac Road to Family Service League, Inc. (FSL) for an annual lease sum of $37,500.00 for a term of five years with an additional renewal of five years, rent to be adjusted annually based upon the Consumer Price Index. The lease provides that FSL shall utilize the leased premises to provide services to the residents of the Town of East Hampton.
A copy of the proposed lease is available for inspection at the office of the Town Clerk during regular business hours.
