The Sound of Breaking Glass

Christian R. Fusco of Ronkonkoma, 25, was sitting on a porch early Sunday morning with another man and a woman, outside apartments on Kirk Avenue in Montauk. The conversation was boisterous enough that a neighbor asked them to quiet down and go inside their unit.

Mr. Fusco walked off, but returned about 20 minutes later, the neighbor told police, shouting at the other two, who were inside, “You have 30 seconds to open this door.” The neighbor, then hearing the sound of breaking glass, looked out her window and saw Mr. Fusco “with his head and shoulder through the window.” 

He ended up in Southampton Hospital, having suffered lacerations as he smashed through the double-paned window, which will cost $600 to replace. Police say he told the first officer on the scene that “You’re here for me. I broke the window.”

Police deemed Mr. Fusco too high on drugs or alcohol to be arraigned Sunday, and he was held for a Monday appearance in East Hampton Town Justice Court, charged with felony criminal mischief and trespassing. He told the court he was working in Montauk for the season as a dishwasher. Bail was set at $5,000, which has since been posted.

A Manhattan man has been in the county jail in Riverside since his arraignment Monday after being arrested Sunday evening in downtown Montauk, Alejandro Gutierrez, 45, is charged with a felony for violating a court order of protection, violently. 

According to police, he was at the beach with Emily Oquendo, who held a protective order against him, issued in Brooklyn. That did not apparently keep the pair from riding out in a friend’s car for a day trip to Montauk. 

“He was drinking Hennesey all day,” Ms. Oquendo told East Hampton Town police. The friend, Dominick Velez, said the two began arguing as they approached his car a little before 4 p.m., in the Kirk Park lot. Mr. Guttierez reportedly began punching the woman. Mr. Velez, trying to stop him, took a few blows as well. “At that point,” he told an officer, “I heard a lady yell, ‘Stop. I’m calling the police.’ ”

Bail for Mr. Gutierrez, who was charged with harassment in addition to the felony, was set the next morning at $5,000. He will be released tomorrow, if not indicted by then, to await a date in criminal court. Mr. Velez declined to press charges.

Guillaume Bruno Emanuel Marconnet-Chalon told the court during his arraignment Monday that he was visiting from France, though on his LinkedIn page he lists himself as a sommelier for two New York restaurants. He had been picked up at 2:30 in the morning on South Edison Street, Montauk, on a misdemeanor charge of possession of cocaine. “I know it’s drugs. I got it in Times Square,” he is said to have told the arresting officer. Bail was set at $100, which was posted.

Not all arrests last week occurred in Montauk. Felipe Marin, 34, was arrested Saturday on Springs-Fireplace Road near Church Street in Springs after allegedly ramming his 1997 Jeep into the rear of Jane Herrera Vargas’s 1993 Subaru. She was seated in the Subaru at the time.

Mr. Marin, who was charged with felony criminal mischief, told East Hampton Town Justice Steven Tekulsky that he lives in Southampton but works at a David’s Lane house in East Hampton. Bail was set at $3,000, which was posted by some co-workers.
