Struck by a Flying Flowerpot

Thu, 05/23/2019 - 07:11

An East Hampton woman, Angelique M. Smith, 39, is facing two felony charges after a domestic altercation with her boyfriend on Aug. 22. East Hampton Town police accused Ms. Smith of repeatedly striking Levy Mwanza before hurling a flowerpot at his head and smashing the front window of his 2003 Ford.

“I smashed his car. He has been cheating on me,” she told police.

Mr. Mwanza told police an argument began after he got off the phone with a cousin, following a prolonged conversation. Ms. Smith sat next to him, he said, and asked if he was happy. “First she was yelling and slapping me, then she started to punch me. She grabbed my shirt and bit my arm.” She is also accused of choking him. He ran outside their Montauk Avenue house as Ms. Smith flung a curling iron and a soap dispenser at him, he reported, but then ran back in and locked himself in the bedroom.

“I looked out my window and saw my motorcycle on its side,” he told police. He raced back outside, headed for the Ford, when, he said, Ms. Smith hurled the flowerpot at him, striking him flush on the head, causing injury and swelling and leading to the felony assault charge. He made it into the car, Mr. Mwanza said, when the woman grabbed a large rock and smashed its windshield, bringing on the second felony charge, criminal mischief. Mr. Mwanza hit the gas and drove off, stopping some distance from the house and dialing 911.

Ms. Smith was additionally charged with obstruction of breathing, a misdemeanor, and harassment. Bail was set at $2,000. She has since been released from custody.

A Wainscott man, Ruben I. Criollo-Chicaza, 33, faces a felony charge of possession of a forged instrument; in this case a Social Security card. The defendant told police on Aug. 22 that, “I got it in Queens. I got it about eight years ago from my friend.” He questioned the quality of the card, according to police. “I think it is cheap. I paid $45 for it.”

Bail was set the next morning at $700, which was posted.
