Sag Harbor Justice Argues in Federal Court

Carl Irace, an East Hampton attorney who is also a Sag Harbor Village Court Justice, is in a Manhattan federal court today to argue an appeal of a case involving “distribution of a controlled substance resulting in death.”

The matter is being heard in the Thurgood Marshall Courthouse in Lower Manhattan before the U.S. Court of Appeals for the Second Circuit. The defendant, James Tunstall, was found guilty of the charge in February 2023 and was sentenced to a term of 30 years in prison.

On his behalf, Mr. Irace will cite the Eighth Amendment’s protections against “excessive punishment” and “deprivation of due process.”

A security guard at Pierson High School in Sag Harbor reported a “suspicious male” wearing a face mask and “riding a bicycle in circles” near the school gym. The young man subsequently told police he was waiting for his friends to get out of school, and said he was wearing a mask “because it’s cold outside today.”

A caller reported a “suspicious package” near the westbound Jitney Stop on Main Street in the village Saturday, describing it as a suitcase next to a garbage can. When police arrived, an 89-year-old woman standing next to the suitcase informed them that it was hers.
