Two Face Felony D.W.I. Charges

Memorial Day’s three-day weekend yielded seven drunken-driving arrests, including a Rocky Point man who was allegedly found with a quantity of cocaine in his 2009 GMC.

Kody J. Zimmer, 30, was stopped on Saturday in Wainscott at about 1:20 a.m., after an East Hampton Town police officer spotted him on Daniel’s Hole Road, swerving. He crossed the solid yellow line and then the solid white line, according to the report, and performed poorly on roadside sobriety tests after being pulled over.

A check of his license turned up a conviction for driving while intoxicated in February 2010. Because it occurred within the past 10 years, he was charged with felony D.W.I.

Police also saw, in plain sight on the floor of the back seat and in the center console, two plastic bags containing a white powdery substance that later tested positive for cocaine. They also found an empty plastic bag containing cocaine residue stuck to Mr. Zimmer’s registration card. Because the cocaine weighed over 500 milligrams, he was charged with another felony, criminal possession of a controlled substance in the fifth degree.

East Hampton Town Justice Lisa R. Rana released him later that morning on $500 cash bail. 

Also facing a felony charge of D.W.I. is a 40-year-old East Hampton man, Carlos A. Rac-Subuyuj, who was previously convicted of the crime on May 20, 2015,  in East Hampton. On Monday, Mr. Rac-Subuyuj was driving a 2007 Nissan, with Oklahoma plates, north on Springs- Fireplace Road on Monday at about 12:45 a.m. when, police said, he failed to maintain his lane of travel. He reportedly failed the roadside tests, and his blood-alcohol level measured above .18, well above the legal limit of .08. 

Justice Steven Tekulsky released him on $10,000 cash bail following arraignment. 

Details of the other D.W.I. arrest reports were not available by press time. 

In Sag Harbor, at about 4 a.m. on May 23, village police reportedly clocked Victor M. Borisov of East Hampton at 50 miles per hour in a 35 m.p.h. zone, and pulled him over on Hampton Street, by Lighthouse Lane, across from the Sag Harbor golf course, for speeding. He was charged with D.W.I. after failing the roadside tests, they said. 

Following a morning arraignment, Mr. Borisov was released on his own recognizance.
