The driver of an eastbound 2017 Mercedes-Benz and his passenger were taken to Stony Brook Southampton Hospital on Nov. 14 after their car veered sharply off Montauk Highway on the Napeague stretch, crashed into several trees, and rolled over near Shipwreck Lane. The driver, Mardiros W. Tavitian, 54, of Manhattan and Williston, was charged with drunken driving as a misdemeanor. Neither he nor his passenger, Elena Kelly, 36, appeared seriously injured, but both agreed to the hospital trip. Mr. Tavitian, who had blood drawn at the hospital, told the arresting officer that he had had wine at the Palm restaurant in East Hampton Village, where he was belatedly celebrating his birthday before the accident. The officer said he showed signs of intoxication; Mr. Tavitian allegedly told her he had swerved to avoid a deer. Mr. Tavitian is to be arraigned in East Hampton Town Justice Court next Thursday. The results of the blood test will likely be available at that time.Martin F. Ryan, 47, of Shirley was charged with driving while intoxicated last week, with a blood alcohol level high enough to raise the misdemeanor charge to the aggravated level. He was arraigned last Thursday after being arrested by East Hampton police the previous night. Police said Mr. Ryan had been driving a 2004 Ford F-150 pickup when he failed to signal a turn from Upland Road onto Clearview Drive in Springs. The erratic turn led to a traffic stop and a series of sobriety tests, all of which Mr. Ryan failed, police said. At headquarters a breath test produced a reading of .25 of 1 percent, well over the .18 that automatically triggers the aggravated charge. East Hampton Town Justice Lisa R. Rana set bail at $1,000, which was posted. A traffic stop of a Beach Hampton resident not far from his Marine Boulevard house led to a misdemeanor drug possession charge by the East Hampton Town police early Sunday morning. Orson A. Frisbie, 31, was driving a 2004 Jeep when, according to police, he ran a stop sign on Mako Lane. At headquarters after his arrest, his breath test came in between .05 and .07 of 1 percent, which, although not high enough to charge him with drunken driving, was consistent with a violation charge of driving with ability impaired by alcohol.However, police had searched his car and allegedly found three cartridges of concentrated marijuana, which led to the possession charge, a misdemeanor. He was released after posting $200 bail, with an arraignment on Jan. 25.
