Felony Rape Charge for Montauk Man

East Hampton Town police have announced the arrest on June 19 of a 31-year-old Montauk man on a charge of first-degree rape, a class B felony. Court documents state that he was involved in an incident with a 6-year-old girl.

The accused man, Evaristo Pineda, who was arrested at his residence, is also charged with endangering the welfare of a child, a class A misdemeanor. The incident is alleged to have occurred between midnight and 12:59 p.m. on Dec. 28, 2023.

Since the case involves a victim under the age of 11, state law classifies it as first-degree rape. Town Justice Court could not immediately provide a follow-up court date.

The office of Suffolk District Attorney Ray Tierney could not provide information on a possible grand jury indictment by press time. The deadline for an indictment was Tuesday.
